Uma carta de vilões? A imprensa e a Lei dos Direitos Humanos

Resumo

A Lei dos Direitos Humanos de 1998 (HRA), uma peça fundamental do campo legislativo que visa o reforço da proteção dos direitos humanos no Reino Unido, tem sido alvo de uma cobertura noticiosa negativa por parte da imprensa desde que entrou em vigor. Os apoiantes desta legislação estão preocupados com o facto de esta estar a ser retratada como uma «carta de vilões», que apenas beneficia os elementos menos merecedores da sociedade. Este artigo analisa os enquadramentos que os jornais têm aplicado aos acontecimentos mais relevantes que envolveram a HRA, não descurando também uma visão geral das reportagens quotidianas sobre o tema. Os resultados sugerem que os enquadramentos são muito mais subtis e diversificados do que se poderia ser levado a pensar a partir do epíteto «carta de vilões». A partir da cobertura noticiosa da HRA em jornais de grande formato quando a lei entrou em vigor na Inglaterra e no País de Gales, demonstrar-se-á como, nesta ocasião em particular, a cobertura revelou diferenças ideológicas assinaláveis. Por outro lado, e tendo em conta um outro acontecimento decisivo no contexto do debate sobre os direitos humanos, que foi a introdução do controverso projeto do Cartão de Identidade, é evidente que o assunto atraiu a imprensa de forma unânime, ainda que nessa ocasião o debate tivesse sido conduzido numa linguagem mais direcionada para a questão das liberdades civis do que dos direitos humanos. Por fim, considerando a cobertura noticiosa dos tabloides sobre um acórdão histórico proferido pelo Comité de Apelo da Câmara dos Lordes, este artigo analisa ainda a identidade daqueles que são qualificados como vítimas merecedoras nas narrativas dos tabloides sobre a HRA.
